1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of fitnessandart.com and any related pages, features, content, products, and services (collectively, the “Site”). The Site is operated by DoFam (“DoFam,” “we,” “us,” or “our”).

These Terms form a binding agreement between you and DoFam. Our Privacy Policy and Shipping & Returns Policy are incorporated into these Terms by reference. Additional terms displayed for a product, promotion, or service also apply.

2. Eligibility and Accounts

You must be at least the age of majority in your place of residence, or use the Site with the involvement and permission of a parent or legal guardian who agrees to these Terms.

If you create an account, you are responsible for:

• Providing accurate, current, and complete information.
• Keeping your password and account access secure.
• All activity conducted through your account, except where caused by our failure to use reasonable security.
• Notifying us promptly if you suspect unauthorized access.

We may suspend or close an account reasonably believed to be fraudulent, compromised, abusive, or in violation of these Terms.

3. Use of the Store

We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Site for lawful shopping and informational purposes.

You may not copy, scrape, automate access to, reverse engineer, interfere with, overload, or attempt to bypass the security of the Site. You may not use the Site or its content for unlawful, fraudulent, infringing, or commercially exploitative purposes without our written permission.

We may modify, suspend, restrict, or discontinue any part of the Site when reasonably necessary for maintenance, security, legal compliance, business operations, or product updates.

4. Products, Images, and Compatibility

We aim to describe and display products accurately. However, colors and details may appear differently depending on your screen, lighting, print process, material, and production batch. Minor variations that do not materially affect ordinary use are not necessarily defects.

Product measurements, availability, features, and images may be updated without notice. Lifestyle photos and digital mockups may be illustrative; the product description and selected variant shown in your cart and order confirmation control.

Made-to-order products

Many DoFam products are produced after you place an order. Production may begin quickly, so changes to the model, design, quantity, or shipping address cannot be guaranteed after submission.

5. Orders and Acceptance

Your order is an offer to purchase the products in your cart. An automated order confirmation means we received your order; it does not necessarily mean the order has been finally accepted.

We may reject, limit, or cancel an order before shipment for reasonable reasons, including:

• Product or material unavailability.
• Pricing, description, inventory, or technical errors.
• Payment authorization or fraud-prevention concerns.
• Suspected resale, abuse, or violation of purchase limits.
• An address or destination we or our fulfillment partners cannot serve.
• Legal, regulatory, sanctions, or carrier restrictions.

If we cancel after payment has been captured, we will refund the canceled amount to the original payment method. Your payment provider may require additional time to post the refund.

Changes and cancellations requested by you

Contact us immediately if you need to change or cancel an order. Because items may enter production soon after checkout, we cannot guarantee any requested change or cancellation once production has started.

6. Pricing, Taxes, and Payment

Prices are shown in the currency indicated on the Site and may change at any time before an order is placed. The price charged is the price displayed at checkout, subject to correction of an obvious error.

Shipping charges and applicable taxes are displayed during checkout when available. International orders may be subject to customs duties, import taxes, brokerage charges, or local handling fees that are not collected by DoFam. Unless checkout expressly states otherwise, the recipient is responsible for those charges.

You authorize DoFam and its payment providers to charge the payment method submitted for the full order total. You represent that you are authorized to use that payment method and that the billing information is accurate.

Payment services are operated by third parties and may apply their own terms and privacy policies. DoFam generally does not receive or store complete payment-card numbers.

7. Shipping and Delivery

Production and delivery dates are estimates, not guarantees. Timing may vary by product, destination, order volume, carrier, customs processing, weather, holidays, or events outside our reasonable control.

You are responsible for entering a complete and accurate delivery address. Additional charges may apply when a package must be resent because of an incorrect or incomplete address, refusal, or failure to collect it.

An order may arrive in more than one package because products can be fulfilled at different facilities. Tracking information may take time to update after a carrier receives a shipment.

Responsibility for loss or damage during delivery will be determined under applicable law and our Shipping & Returns Policy. Nothing in these Terms removes rights that cannot lawfully be excluded in your place of residence.

8. Returns, Refunds, and Warranty

Our current return, refund, damaged-item, and warranty rules are explained in the Shipping & Returns Policy. At the date shown above, the policy includes a 30-day return-request period for eligible items and a 12-month limited warranty for eligible defects in printing or materials under normal use.

Returns require prior approval. Do not send a product to the sender address on its shipping package unless we specifically instruct you to do so. Unauthorized returns may not reach the correct facility and may not qualify for a refund.

The following are generally excluded unless mandatory law provides otherwise:

• Ordinary wear, scratches, fading, or cosmetic changes from normal use.
• Damage from drops, impact, accidents, misuse, improper care, modification, or unauthorized repair.
• Products incompatible because the customer selected the wrong device model.
• Used, altered, damaged, final-sale, or otherwise non-returnable items identified in our policy.

These Terms and our policies do not limit any non-waivable consumer rights available to you under applicable law.

9. Promotions, Discounts, and Gift Cards

Promotional codes are subject to any stated eligibility, product, geographic, quantity, and expiration restrictions. Unless expressly stated, discounts cannot be combined, applied retroactively, exchanged for cash, or used toward shipping, duties, or taxes.

We may correct or cancel a promotion affected by an error, fraud, abuse, or technical failure. If gift cards are offered, additional terms presented at purchase apply.

10. Reviews and User Content

You may be able to submit reviews, photographs, comments, questions, or other content (“User Content”). You retain ownership of your User Content.

By submitting User Content to the Site or directly to DoFam for publication, you grant DoFam a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, format, adapt, publish, translate, display, and distribute that content for operating, improving, and promoting DoFam and its products, subject to our Privacy Policy and applicable law.

You represent that you have the rights and permissions needed to submit the content and that it is accurate to your genuine experience. User Content must not be unlawful, deceptive, defamatory, threatening, obscene, infringing, privacy-invasive, malicious, or promotional spam.

We may moderate, decline, or remove User Content that violates these Terms or applicable law. We do not promise to publish every submission, and views expressed by customers do not necessarily represent DoFam.

11. Intellectual Property

The Site and its original text, graphics, designs, photographs, illustrations, videos, logos, trade dress, layout, code, and other content are owned by or licensed to DoFam and are protected by applicable intellectual-property laws.

No right, title, or license is transferred to you except the limited right to use the Site under these Terms. You may not reproduce, modify, distribute, sell, license, remove rights notices from, or create derivative works from protected Site content without prior written permission from the relevant owner.

Third-party names, trademarks, device models, and product references belong to their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.

12. Prohibited Conduct

You must not:

• Use the Site for unlawful, fraudulent, abusive, or misleading activity.
• Attempt to gain unauthorized access to accounts, systems, data, or non-public parts of the Site.
• Introduce malware, harmful code, or automated traffic that disrupts the Site.
• Scrape, harvest, or collect information from the Site except as permitted by law or written agreement.
• Impersonate another person or misrepresent your affiliation.
• Use stolen payment credentials, abuse chargebacks, or evade purchase restrictions.
• Infringe intellectual-property, privacy, publicity, or other legal rights.
• Interfere with another customer’s use of the Site.

We may investigate suspected violations and cooperate with payment providers, carriers, platforms, or authorities as permitted or required by law.

13. Third-Party Services and Links

The Site may depend on or link to third-party commerce, hosting, payment, production, fulfillment, shipping, analytics, advertising, review, customer-support, and social-media services. Those services may be governed by separate terms and privacy policies.

We are not responsible for third-party websites or services that we do not control. A link or integration does not necessarily mean DoFam endorses every third-party statement, product, or practice.

14. Disclaimers

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as available” basis. We do not guarantee that the Site will always be uninterrupted, error-free, secure, or free of harmful components, or that all content will be complete or current at every moment.

Products are not represented as preventing all damage to a phone, device, or other property. Protective performance depends on the product, device, impact, installation, condition, and use. DoFam is not responsible for damage to a phone or other device except to the extent liability cannot lawfully be excluded.

Nothing in these Terms excludes express warranties we provide, non-waivable statutory warranties, or consumer guarantees that apply to your purchase.

15. Limitation of Liability

To the fullest extent permitted by applicable law, DoFam and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for loss of profits, revenue, data, goodwill, or business opportunity arising from or related to the Site or products.

To the fullest extent permitted by applicable law, DoFam’s total liability for a claim relating to a product, order, or use of the Site will not exceed the amount you paid to DoFam for the product or order giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence where liability cannot be limited, or any other liability or consumer right that applicable law does not allow us to exclude or limit.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DoFam and its owners, personnel, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, or User Content that infringes another person’s rights.

This section does not require you to indemnify DoFam for its own negligence, willful misconduct, or breach of law.

17. Governing Law and Disputes

These Terms are governed by the laws applicable in the jurisdiction where DoFam is established, without regard to conflict-of-law principles, except where mandatory consumer law in your place of residence applies.

Before starting formal proceedings, please contact us and provide your name, order number if relevant, a description of the issue, and the resolution you are seeking. We will make a reasonable effort to resolve the matter informally.

If a dispute cannot be resolved informally, it may be brought before a court with lawful jurisdiction. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using a consumer-protection process available under applicable law.

18. General Terms

Severability

If any provision is found invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.

No waiver

A delay or failure to enforce a provision is not a waiver of our right to enforce it later.

Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms in connection with a reorganization, financing, merger, acquisition, sale, or transfer of all or part of our business, subject to applicable law.

Force majeure

Neither party is responsible for delay or failure caused by events beyond reasonable control, such as natural disasters, severe weather, war, terrorism, civil unrest, public-health emergencies, labor disruption, carrier or utility failure, supply shortage, cyberattack, or government action. Payment obligations already due are not excused.

Entire agreement

These Terms and the policies or additional terms incorporated by reference form the entire agreement between you and DoFam regarding the Site and purchases, replacing prior discussions or communications on the same subject.

19. Changes to These Terms

We may update these Terms to reflect changes in our products, services, business practices, technology, or legal obligations. The “Last updated” date shows when the current version took effect.

Changes apply prospectively when posted unless applicable law requires additional notice. Your continued use of the Site after an updated version takes effect means you accept the revised Terms. The Terms in effect when you place an order generally govern that order, except where a change is required by law.
